Nadorcott Protection (NCP) – which holds the intellectual property rights for the Nadorcott mandarin variety (thanks to a UK Plant Breeder Right) – has contacted nine major retailers in the UK regarding unauthorised sales of Tango/Tang Gold. NCP believes that these sales are in breach of the PBR covering the Nadorcott mandarin. In letters sent to Aldi, Asda, Co-op, Lidl, Marks & Spencer, Morrisons, Sainsbury’s, Tesco and Waitrose, NCP representatives warned the retailers of the potential risks associated with unauthorised Tango/Tang Gold transactions in the UK.
The Community Plant Variety Office (CPVO), which is the highest authority in terms of plant varieties in the EU, confirmed that there are only two differences between the Nadorcott mandarin and the irradiated Tango/Tang Gold variety. In light of these revelations, NCP regards the Tango/Tang Gold mandarin as a dependent variety, and “essentially derived” from the protected Nadorcott mandarin.
