An important intervention by UPOV

The new explanatory note on essentially derived varieties, adopted at the end of October by UPOV (International Union for the Protection of New Varieties of Plants), made some important clarifications, strongly favouring the arguments set out by Nadorcott Protection since the start of its proceedings against Tango. Varieties obtained by induced mutation, presenting the same essential characteristics as the original variety, are deemed to be essentially derived. As such, a variety of this kind may not be marketed without the authorisation of the breeder of the original variety.

Hence, Mr. Mohammed Benbiga, representing Nadorcott Protection stated: “We have always maintained that the Tango/Tang Gold mandarin should be classified as an essentially derived variety of Nadorcott, itself protected, and UPOV has completely confirmed this point of view. We believe that this major development will contribute not only to protecting varieties (such as Nadorcott), but also to safeguarding the future of ethical research, innovation and procurement.”
