Nadorcott Protection (NCP) has initiated a lawsuit against one of the UK’s largest supermarkets, in the latest escalation of its efforts to protect its rights over the Nadorcott variety, and specifically in connection with the unauthorized sale of Tango/Tang Gold mandarins. The UK is the third market in which NCP has launched legal action to protect the Nadorcott variety against unauthorised exploitation of Tang Gold. These efforts have also been extended to other European markets. Warning letters have also been sent to supermarket retailers across Europe informing them of the risks involved in the unauthorised sale of the Tango/Tang Gold variety. This legal action comes months after NCP publicly confirmed its commitment to take all available actions in appropriate jurisdictions to protect the Nadorcott variety, with the support of key global stakeholders. This action was bolstered by the recent adoption of new Explanatory Notes on Essentially Derived Varieties by the International Union for the Protection of New Varieties of Plants (UPOV) Council. NCP’s view is that this UPOV document supports its long-held assertion that the Tango/Tang Gold variety falls within the extent of protection of the award-winning Nadorcott variety.
